The old debate about the scheme of distribution of competence between referees and judges about opposite acts to the arbitration agreement, it is exceeded as a result of the fulfillment, of an arbitration agreement, litigation covering this already will be unresolved by the official courts of any State but by an arbitral tribunal. Thus the parties, by their own volition, exclude jurisdiction. Las medidas precautorias son un instrumento de impartición de justicia que ayuda a aplicar de acuerdo al derecho la ejecución eficaz y completa de una sentencia o laudo arbitral. El viejo debate sobre el régimen de distribución de competencia entre árbitros y jueces en materia de impugnaciones al acuerdo arbitral, (entre ellas la relacionada con la facultad de dictar medidas precautorias), se encuentra superado como consecuencia de la celebración de un convenio arbitral, el o los litigios que éste abarca ya no serán resueltos por los tribunales oficiales de ningún Estado sino por un tribunal arbitral. Así las partes, por su propia voluntad, excluyen la competencia judicial.
