The objetive of the article is to distinguish the discrimination of the gay indigenous people and to identify how the right to be voted is violated. The research has a qualitative approach; semistructured interviews were conducted, the snowball method and the exegetical method were used. Certain electoral institutions limit or hinder the participation of gay indigenous people in municipal candidacies, because they are based on the personal interests of a social group that remains in power. Discriminatory conduct and the violation of the right to political participation remain in force, despite progress in legislative matters. La discriminación múltiple que enfrenta la población indígena es la antesala de la violación de los derechos humanos. El objetivo del artículo es distinguir la discriminación de las personas indígenas gais e identificar cómo se viola el derecho a ser votado. La investigación tiene un enfoque cualitativo; se realizaron entrevistas semiestructuradas, se utilizó el método de bola de nieve y el método exegético. Ciertos órganos electorales limitan u obstaculizan la participación de las personas indígenas gais en las candidaturas municipales, porque se basan en intereses personales de un grupo social que se mantiene en el poder. Siguen vigentes las conductas discriminatorias y la violación del derecho a la participación política, a pesar del avance en materia legislativa.
