Abstract The objective of this research is to address the business valuation within the bankruptcy proceedings, carrying out a comparative law exercise, that is, contrasting what is established by the Mexican Bankruptcy Law (Ley de Concursos Mercantiles) and the United States Bankruptcy Code, in conjunction with the practice carried out in both countries on this issue. Therefore, based on this comparison, legal and financial elements are provided within the business valuation, which could help to strengthen the bankruptcy proceedings in Mexico. Resumen El objetivo de la presente investigación es abordar la valuación de empresas dentro de la figura jurídica del concurso mercantil, llevando a cabo un ejercicio de derecho comparado, es decir, contrastando lo establecido por la Ley de Concursos Mercantiles de México y el Código de Quiebras de los Estados Unidos de América, en conjunto con la práctica llevada a cabo en ambos países en este tema. Por lo que, a partir de esta comparación, se aportan elementos de índole jurídico y financiero dentro de la valuación de empresas, que podrían coadyuvar en robustecer el procedimiento concursal mercantil en México.
