description Abstract Since the emergence of labor legislation in our country, conciliation has always been present, however, despite the historical existence of this figure, as a means of solving labor disputes, the courts responsible for the administration of justice, in this matter, will be characterized by a large accumulation of files; which originates, that the procedures in these instances take place very slowly, contrary to the right that we citizens have in the sense that justice is administered to us in an expeditious manner, and within the terms and terms established by the laws, established in the Article 17 of our Magna Carta. Why is it that conciliation as an alternative means to resolve disputes that arise in labor-management relations has failed? Could it be that the interests between these two social classes are irreconcilable? The little support, in infrastructure, personnel, etc. that the state has granted to the Conciliation and Arbitration Boards has been a determining factor, which has caused tortuguism in the processing of labor lawsuits. In Mexico, from the reforms to Constitutional Article 123, published on February 24, 2017 and later with the reform of its regulatory law, the Federal Labor Law on May 1, 2019, a new stage began, in the case of the administration of labor justice; conciliation playing a leading role; Well, from the outset it is no longer part of the labor procedure, contemplating the preliminary conciliation procedure, which must be carried out compulsorily, before starting the trial, without the parties being obliged to conciliate, if not only to attend the process; Creating for this purpose the conciliation centers, in local matters, and in federal matters, the federal centers of conciliation and labor registration.             This decision in favor of a conciliatory option is fundamental, we hope it works and finally we have in the Courts the least number of trials possible, which allows the processes to be agile; For justice that is not prompt and expeditious is not justice.

Desde el surgimiento de la legislación laboral en nuestro país, la conciliación siempre ha estado presente, sin embargo, a pesar de la existencia histórica de esta figura, como medio de solución del conflicto laboral, los tribunales encargados de la impartición de la justicia, en esta materia, se caracterizarán, por un gran cúmulo de expedientes; lo que origina, que los tramites en estas instancias transcurran con mucha lentitud, contrario al derecho que tenemos los ciudadanos en el sentido de que se nos administre justicia en forma expedita, y dentro de los plazos y términos que fijen las leyes, establecido en el artículo 17 de nuestra carta magna. ¿A qué obedece que la conciliación como medio alternativo, para resolver las controversias que se susciten, en las relaciones obrero patronales haya fracasado? ¿Sera acaso que los intereses entre estas dos clases sociales, son irreconciliables? El poco apoyo, en la infraestructura, personal, etc. que el estado les ha otorgado a las Juntas de Conciliación y Arbitraje ha sido un factor determinante, que ha provocado el tortuguismo en la tramitación de los juicios laborales.   En México a partir de las reformas al artículo 123 Constitucional, publicada el 24 de febrero del 2017 y posteriormente con la reforma a su ley reglamentaria, la Ley Federal del Trabajo el 01 de mayo del 2019, se inició una nueva etapa, en tratándose de la impartición de justicia laboral; desempeñando la conciliación un papel protagónico; Pues de entrada ya no forma parte del procedimiento laboral, contemplándose el procedimiento de conciliación prejudicial, mismo que deberá llevarse a cabo obligatoriamente, antes de iniciar el juicio, sin que las partes estén obligadas a conciliar, si no solo a acudir al proceso; Creándose para tal efecto los centros de conciliación, en materia local, y en materia federal, los centros federales de conciliación y registro laboral.             Esta decisión en favor de una opción conciliatoria es fundamental, esperemos funcione y por fin tengamos en los Tribunales el menor número de juicios posibles, que permita que los procesos sean agiles; Pues justicia que no es pronta y expedita no es justicia.
